Rights in the Content
1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. Federal, state and local laws and regulations apply. Taxes, customs, duties and like amounts in connection with the prizes are the winners' responsibility.
2. The Aniboom and HISTORY present The People Speak Competition (the "Competition") shall be administered by Aniboom Ltd. ("Aniboom" or the "Administrator"). The sponsor of the Competition is A & E Television Networks, d/b/a History ("Sponsor"). The Competition shall be regulated and governed by the rules and regulations set forth below and The People Speak Competition
(collectively the "Regulations").
3. The Competition's objective is to promote The People Speak television special by promoting the creation of original, creative and unique animation content based on footage/material from "the People Speak" provided by the Sponsor for use by the Competitor (defined below) (the "Content"). The Content must incorporate certain audio provided by the Sponsor (the Sponsor Materials as defined in the Submission Agreement) for submission to the Competition, and all Content must be in accord with the Regulations.
4. Content will be submitted to the Contest, and displayed on the Competition's website (http://www.aniboom.com/History - the "Website").
5. Visitors to the Competition's Website will vote on their favorite animation, and prizes for the winning Content will be awarded as further detailed in the Regulations.

6. Information for Competitors
Any individual, and all members of any group of individuals submitting Content, ("Competitor(s)") must be at least eighteen years of age and have reached the age of majority in the jurisdiction within which they reside at time of entry submission. Competitors must have Internet access as of the time of submission of the Content. Producers who are currently engaged in contractual relationships or development deals that would preclude them from participating in any part of the Competition are not eligible to participate. Competitors must be able to sign an assignment and a development agreement with Sponsor or Aniboom, which is a mandatory condition to be eligible for the Finalist and Grand Prize awards. Each Competitor must be the rightful owner (or have authorized use) of the e-mail address identified in the Competitor's entry. In the event of a dispute as to the identity of a winner, the winner will be deemed to be the natural person in whose name the e-mail account associated with the provided e-mail address was opened. Employees, shareholders, officers, directors, agents, and representatives of Aniboom and Sponsor, and each of their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives and promotion and advertising agencies (collectively, "Competition Entities"), together with the immediate family members and those living in the same household of such persons, are not eligible to participate in the Competition. This Competition is void where prohibited.
Qualifications for Entries to the Contest
Any Content submitted to the Competition must meet the following qualifications:
The Content, except for the Sponsor Materials, must be the original work of the creating Competitor and should not include any third party content, or content used in violation of any copyright or any other intellectual property right.
Prior to submission or during the Competition Term (as defined in Section 8) Competitor may not commercially exploit the Content in any way, including without limitation any sale, license, or distribution.
The Content MUST NOT:
Contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing;
Except for the Sponsor Materials, include mention or performance of any copyrighted media production including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media property.
Have been previously submitted to another contest, broadcast on a competing media network or submitted to any entertainment entity that would conflict with this Competition, as determined in Aniboom's and the Sponsor's sole discretion.
Include 3rd party trademarks, logos, insignia, location signage, photographs, artwork, or sculptures;
Contain any derogatory references to Aniboom or any Sponsors; or
Include 3rd parties, including but not limited to minors, celebrities and friends who have not expressly authorized entrants to display their image, likeness or voice in any submitted video or otherwise use such image, likeness or voice in accordance with these Regulations.
Except for any music contained in the Sponsor Materials, any music featured in the Content must be originally written, performed and produced by Competitor only and must be available to publicize and broadcast on a license-free, no compensation basis.

7. Entry Procedures
7. To enter:
to download "The People Speak" audio files.
Choose the audio file you want to use as your vocal track and select the parts you want to animate (up to 30 seconds); also provided are special music soundtracks that can be utilized with your vocal track.
Create an original animated storyboard, animatic, or animation with your chosen audio clip.
Animate the clip in whatever way it inspires you to.
Content should be submitted to the Competition during the Submission Period (see Section 8 below) by uploading the Content according to the instructions on the Website at
All Competitors must agree to the Submission Agreement by clicking on the "I ACCEPT" button which constitutes your acceptance and execution of the Submission Agreement. Acceptance of the Submission Agreement is a mandatory pre-condition to each Competitor's participation in the Competition.
No other method of submission will be accepted.

8. The Competition
8.1 Administrator's Discretion
8.1.1 Aniboom reserves the right to cancel the Competition at its sole discretion at any given time, without notice, obligation or liability, including without limitation, the award of any prizes or prize money.
8.1.2 Aniboom reserves the right to remove any Content submitted to the Competition at its sole discretion at any time during the Competition, without notice, obligation or liability, including without limitation, the award of any prizes or prize money.
8.2 Rating and Voting Mechanism
8.2.1 Rating and voting during the Rating Period (as defined below) will be in accordance with the rating mechanism to be provided and administered by Aniboom in its sole discretion. Aniboom and its Sponsors shall solely and exclusively operate the rating and voting on the Website.
8.2.2 Four (4) Finalist(s) will be selected by an editorial committee from Aniboom and its Sponsors, and one will be selected based on audience ranking. Audience ranking is calculated using a formula which takes into account the audience's engagement with each entry. The data includes the number of times each entry is rated, the average ratings given, the number of times each entry is shared, the total number of comments and views that each entry receives, and the length of each view.
8.3 Competition Phases and Term
The Submission Period:
Content may be submitted from July 15, 2009 (12:00AM ET) until September 2, 2009 (11:59PM ET). All Content must be received by September 2, 2009 (11:59PM ET).
The Competition timeline:
July 15 (12:00AM ET) - launch competition, begin accepting submissions.
Sept 2 (11:59PM ET) - submissions deadline.
Sept 16 - announce 5 Finalists.
Sept 16 - Nov 4 (11:59PM ET) (7 weeks total) - 5 Finalists get 7 weeks to produce the 30 second fully animated final spot, others are invited to submit 30 second spot and 1 Wildcard Finalist will be awarded to join the group of Finalists.
Nov 4 (11:59PM ET) - deadline for final submissions and Wildcard Finalist entries.
Nov 18 - announce Wildcard Finalist and begin 2 week Finalist promotional period.
Dec 2 (on or about) - announce Grand Prize Winner.
The term of the Competition shall commence upon the Submission Period and end sixty (60) days after the awarding of the Grand Prize (the "Competition Term").

Aniboom shall award prizes as follows:
9.1 Each of the five (5) Finalists will be awarded a prize of five thousand dollars ($5,000).
9.2 The Grand Prize Winner(s) will be awarded an additional prize of ten thousand dollars ($10,000) in cash and a development deal with Sponsor and Aniboom to complete a promotion for The People Speak special valued at fifteen thousand dollars ($15,000).
9.3 Prize money will be paid to the winning Competitors via check or wire transfer according to information provided by Competitor upon submission as set forth in the Submission Agreement. Other prizes will be issued according to the mailing addresses provided by the Competitors upon the receipt of all Agreements specified in these Regulations.
9.4 All prizes will be sent to the winners only after the official conclusion of the entire Competition.
9.5 Each potential winner and his/her entry shall be subject to verification and the requirements of these Official Rules. Aniboom will notify prize winners by mail, e-mail or telephone. Aniboom/Sponsor will require prize winners to execute an affidavit of eligibility, publicity release (except where prohibited), liability waiver and/or IRS Form W-9 (if required by IRS regulations) prior to the delivery of any prize (collectively, "Affidavit"). If a prize winner does not respond to the prize notification within 5 days, is found to be ineligible, fails to execute any documentation required by Sponsor and/or a prize is returned as undeliverable, Aniboom will consider such prize winner to have forfeited the prize and another prize winner will be selected as time allows. Aniboom reserves the right to modify notification procedures in its sole discretion, if necessary due to time constraints. Aniboom/Sponsor reserves the right to disqualify any Competitor for any reason, including without limitation, if that Competitor has not complied with these Official Rules or has interfered, in Aniboom's/Sponsor' sole opinion, with the proper conduct of this Contest. Payment of all taxes is the sole responsibility of each prize winner. Prize winners may be issued an IRS Form 1099 for the approximate value of the applicable prizes.
9.6 If it is found that a prize recipient does not hold full rights to the winning Content, or otherwise violates the Regulations or Submission Agreement, prizes may be withheld or reimbursement required for already issued prizes.
9.7 Aniboom/Sponsor reserve the right to remove Content from the Competition or to choose not to publish Content, if in either of their sole discretion, such Content violates the Submission Agreement, Regulations, or other agreement between Competitor and Aniboom/Sponsor.
9.8 To be eligible to win prizes, Competitors may be required to execute additional agreements confirming the Regulations of the Competition (including without limitation the Submission Agreement) and other requirements as may be established by Aniboom and Sponsor. By accepting a prize, winners consent to the use of their names, voices, photographs and/or other likenesses for advertising or publicity purposes without additional compensation, except where prohibited by law. By entering, all Competitors release Aniboom, Sponsor, and their parent companies, affiliates, subsidiaries, vendors, agencies, officers, directors, agents, employees, suppliers and all others associated with the development or execution of this sweepstakes from any and all liability with respect to, or in any way arising from, this contest or the acceptance, possession or use of any prizes including, without limitation, liability for any personal injury, damage or loss.
9.9 Prizes are limited to one prize per person and per household.

10. Forbidden Voting
10.1 Rating and voting shall take place and prizes to the winning Content shall be awarded according to sections 8 and 9 of the Regulations above.
10.2 Competitors are strictly forbidden to rate their own Content, or make any other manipulations to the voting process that employ non-legitimate means of increasing the rank of an entry. These means may include such things as hacking into the voting mechanism or the use of automated robots. All rating must be done by actual individuals voting for the Content according to a one- person-one vote system. If Aniboom considers that any of the Competitors or anyone on his/her behalf has used illegitimate means to affect the rating and voting process, it shall be entitled, upon its sole discretion, to immediately remove this Competitor's Content from the Competition.

11. Information for Visitors
11.1 Visitors are invited to view and enjoy all Content as well as rate and vote for their favorite Content, according to the terms, phases and rules set out hereinabove, using the rating and voting mechanism provided by Aniboom on the Website.
11.2 All visitors to the Website shall be able to rate the Content and vote for them each one time, in accordance with section 8 above.
11.3 Visitors are strictly forbidden to make or assist in any manipulations to the voting process such as hacking, or double voting.

12. Rights in the Content
Aniboom and Sponsor shall have rights in the Content as set out in the Submission Agreement.

By entering the Competition, you grant Aniboom permission to share your email address and any other personally identifiable information with the Sponsor solely for the purpose of judging and prize fulfillment. Aniboom will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the Sponsor and contractors used to provide this Competition and the Website.

14.1 These Regulations are a part of the Submission Agreement and are governed by its terms.
14.2 For a list of winners or a copy of these official rules, mail a self-addressed, stamped envelope to: ANIBOOM, 5 Morton St, Ground Floor NYC, NY 10014, USA within thirty (30) days after the Competition Term (VT residents may omit return postage).
